Sleep Well Lady — Terms of Service

1. Who we are

Sleep Well Lady is a personal safety iOS app operated by Katie Dickieson (sole proprietor), based in St. Petersburg, Florida, USA. References to "we," "us," and "our" mean the operator. References to "you" and "user" mean a person who downloads, installs, and uses the Sleep Well Lady iOS app.

2. What the app does

Sleep Well Lady is a software application that runs on the user's iPhone and is intended to assist the user in summoning help from their pre-designated trusted contacts during a perceived personal-safety emergency. It is a supplement to — not a replacement for — emergency services such as 911. The app's core functions include: optional ambient sound and motion monitoring, a manual silent-alert button on the home screen, and outbound SMS / email delivery of alert messages with the user's location to trusted contacts the user has personally added.

3. Acceptance

By installing and using the Sleep Well Lady iOS app, you accept these Terms of Service. SMS opt-in consent for trusted-contact recipients is collected separately on a dedicated standalone consent page (sleepwelllady.com/opt-in.html) and is independent of these Terms of Service. Acceptance of these Terms by the app user does not constitute SMS opt-in by any other person.

4. Eligibility

You must be at least 18 years old to use the app. The app is intended for use in the United States. Use of the SMS alert system in a country where Twilio toll-free SMS is not supported may result in undelivered messages.

5. Trusted contacts

You are solely responsible for ensuring that any phone number or email address you add as a trusted contact in the app belongs to a person who has independently agreed to receive SMS or email messages from our service. You agree not to add any contact who has not given that consent. We provide a standalone opt-in page (sleepwelllady.com/opt-in.html) for that purpose.

6. No emergency-service guarantee

Sleep Well Lady is software. It cannot guarantee message delivery, location accuracy, response time, or that any trusted contact will receive, see, or act on a safety alert. We make no warranty that the app will prevent harm. In an emergency where you are able, call 911 or your local emergency number directly.

7. Privacy

Our handling of personal data is described in our Privacy Policy. SMS-specific consent and opt-out practices are described in our SMS Consent & Opt-In Policy.

8. Disclaimer of warranties

The app is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and noninfringement. To the maximum extent permitted by law, we disclaim all liability for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of the app.

9. Termination

You may stop using the app at any time by deleting it from your device. We may suspend or terminate the service for any user we reasonably believe is misusing it, including using the SMS alert system to send messages to recipients who have not consented.

10. Changes

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date at the top of this page.
